1. About this Policy
This Privacy Policy explains how BETMAN LIMITED, a company registered in New Zealand (we, us or our), handles personal information when you use the BETMAN website, account, checkout, RacingOS and related horse-racing information and analysis features (together, the Service).
We are responsible for the personal information described in this Policy and handle it under New Zealand's Privacy Act 2020 and Information Privacy Principles. Other mandatory privacy rights may apply depending on your location.
In summary, we collect information needed to operate accounts, payments, subscriptions, security and requested horse-racing features. Stripe handles payment processing, and you should never send us full payment-card details, passwords or security codes.
2. Information we collect
Depending on how you use the Service, we may collect:
- Account information, such as your name, email address, username, account identifiers and sign-in information;
- Purchase information, such as the selected product, promotion or voucher code, transaction reference, invoice and subscription status received from Stripe;
- Service content, such as selected races or runners, prompts, questions, watchlists, Bet Plans, feedback, requested analysis and AI-assisted outputs;
- Communications, including support, billing, privacy or complaint messages; and
- Technical and usage information, such as IP address, browser or device type, operating system, login events, timestamps, pages or features used, and error or security logs.
We collect information directly from you, automatically when you use the Service, and from providers that support a transaction, account or requested feature. For example, Stripe provides information needed to confirm payment and manage access.
If we collect personal information about you from another person or organisation, we will take reasonable steps to tell you about the collection, its purpose, intended recipients, our identity and contact details, any law authorising or requiring collection, and your access and correction rights, unless a lawful exception applies.
3. How we use information
We may use personal information to:
- create, authenticate, secure and administer accounts;
- process purchases and manage subscriptions or access;
- provide horse-racing information, analysis and other requested features;
- save preferences or content where the feature supports this;
- send account, security, billing, service or support messages;
- respond to enquiries, complaints and privacy requests;
- detect and investigate fraud, misuse or security incidents;
- operate, troubleshoot and improve the reliability and quality of the Service;
- maintain financial, tax, legal and security records; and
- comply with legal obligations or exercise and defend legal rights.
We use information for the purpose for which it was collected, a related purpose, with your authorisation, or where law otherwise permits or requires it.
We may send promotional messages where we have the required permission or other lawful basis. Each promotional message will identify us and provide an unsubscribe method. You may still receive messages needed to administer an active account, purchase or security issue.
4. AI-assisted features
When you use an AI-assisted feature, we may process your race selections, prompts, questions, instructions and related information to generate, secure and support the requested analysis.
AI and infrastructure providers may process this information on our behalf. Do not include unnecessary personal information about yourself or anyone else in a prompt or analysis request. If we propose to use submissions or identifiable information to evaluate, improve or train a model, or for another materially different purpose, we will provide additional notice and obtain authorisation where required.
5. Payments, cookies and communications
Stripe provides hosted checkout and subscription management. Stripe may collect contact, billing, payment-method and transaction information under Stripe's Privacy Policy. We receive or access information needed to confirm payment, provide access, manage subscriptions, handle disputes and keep required financial records. We do not ask you to send full card details to us.
We use cookies, local storage or similar technologies where needed for sign-in, account sessions, security, checkout and preferences. We may also use these technologies to understand Service performance, diagnose errors or measure feature use. You can control them through your browser and any preference controls we provide, although blocking essential technologies may prevent account or checkout features from working.
If we introduce advertising, targeted tracking or another materially different use of these technologies, we will update this Policy and provide any notice or choice required by law.
6. When we share information
We may share personal information with:
- Stripe and other providers supporting payments, hosting, databases, authentication, communications, support, security, monitoring, analytics or AI;
- accountants, auditors, insurers, lawyers and other professional advisers;
- a person you authorise or direct us to share it with;
- courts, regulators, law-enforcement bodies or other parties where disclosure is required or authorised by law;
- parties reasonably involved in investigating fraud, misuse or a security incident; or
- a buyer, investor or adviser involved in a genuine business sale, financing or reorganisation, subject to appropriate confidentiality and legal protections.
Providers receive information reasonably needed for their role and must handle it under the applicable contractual and legal requirements. We remain responsible for our own privacy obligations.
7. Overseas processing, security and retention
Some providers may store, access or process personal information outside New Zealand. Before making an overseas disclosure, we will use an appropriate contractual safeguard, comparable-protection basis, authorisation or other basis permitted by New Zealand law. A provider acting only as our agent may process information overseas on our behalf, and we remain responsible as provided by law.
We take reasonable safeguards appropriate to the information and risks involved, which may include access controls, account protections, encrypted transmission, monitoring, backups and provider management. No online system is completely secure. Contact us promptly if you believe your account or information is at risk.
We keep personal information only for as long as reasonably needed to provide the Service or transaction, meet financial or legal obligations, resolve disputes, maintain security records, or exercise and defend legal rights. When it is no longer required, we take reasonable steps to delete it or make it non-identifying, subject to lawful retention and backup cycles.
8. Your privacy rights
You may ask whether we hold personal information about you, request access to it, or ask us to correct inaccurate, incomplete, out-of-date or misleading information. If we do not make a requested correction, you may ask us to attach a statement of correction.
Send requests to support@betman.co.nz. We may ask for information reasonably needed to verify your identity, authority and the relevant records. Under New Zealand law, a decision on an access or correction request is generally required within 20 working days, subject to lawful extensions and withholding grounds.
You may also request account closure, deletion or a copy of information. These rights are not absolute, and we may retain information where reasonably needed for a transaction, legal obligation, dispute, security record or legal claim. Account closure or deletion does not necessarily cancel a subscription; use the Stripe billing portal or contact us for billing assistance.
9. People under 18
The Service is intended only for people aged 18 or older. A person under 18 must not create an account, purchase access or use the Service.
If we learn that a person under 18 has provided personal information contrary to these rules, we may restrict or close the account and take appropriate steps to delete the information, subject to any lawful reason to retain it.
10. Privacy breaches and complaints
We will assess and respond to suspected privacy breaches. If a breach has caused or is likely to cause serious harm, we will notify the New Zealand Office of the Privacy Commissioner and affected people as soon as practicable where required by law. We will also comply with any applicable notification duty in another jurisdiction.
If you have a privacy concern, contact our Privacy Officer at support@betman.co.nz and describe the issue and the outcome you seek. We will investigate and respond within a reasonable time. If you are not satisfied, you may contact the New Zealand Office of the Privacy Commissioner.
11. Changes and contact details
We may update this Policy when the Service, providers, information practices or legal obligations change. We will post the revised version and update the "Last updated" date. We will provide additional notice or seek authorisation where required for a material change.
